Instructions for Extending or Re-issuing a Permit

Regarding Tolling of expiration dates due to the State of Emergency.

On September 23rd, 2022, The Governor of Florida issued Executive Order 22-218, declaring a State of Emergency, related to Tropical Storm Ian, which then turned into Hurricane Ian before making landfall on the gulf coast of Florida. 

Because Executive Order EO 22-218 was amended by Executive Order EO 22-219 and extended by Executive orders EO 22-268 and EO 23-60 and EO 23-104 and EO 23-139 and EO-23-176 and EO-23-214 and EO-24-02 and EO-24-36 the State of Emergency will end on April 30th, 2024, unless the State of Emergency is extended further.

Because of this State of Emergency, Florida Statute 252.363 has gone into effect.

"The emergency declaration extends the period remaining to exercise the rights under a permit or other authorization for 6 months in addition to the tolled period. This paragraph applies to the following:

1. The expiration of a development order issued by a local government.

2. The expiration of a building permit.

3. The expiration of a permit issued by the Department of Environmental Protection or a water management district pursuant to part IV of chapter 373.

Within 90 days after the termination of the emergency declaration, the holder of the permit or other authorization shall notify the issuing authority of the intent to exercise the tolling and extension granted under paragraph (a). The notice must be in writing and identify the specific permit or other authorization qualifying for extension."

At this time permit holders have 90 days from April 30th, 2024 to apply for this type of extension, which would be July 29th, 2024.  Effectively, permits expiring September 23rd, 2022 through July 29th, 2024 can be extended without an extension fee.

If the State of Emergency is extended we will extend the tolling and post the new details on this page.

If your permit or development order expires, between September 23rd, 2022 and July 29th, 2024  use this process:

Complete an Extension/Reissuance form, which is available on our forms page. (Link to Form)

Filling out the form:

  • The date of the email is the request date for the extension.
  • Reference full permit or development number and job site address.
  • Specifically refer to the Executive Orders and Florida Statutes with the following phrase:
  • “Requesting tolled expiration per EO 22-218, EO 22-0219, EO 22-268, EO 23-60, EO 23-104, EO 23-139, EO 23-176, EO 23-214, EO 24-02, EO 24-36 - and F.S. 252.363.”

Staff will attach your request to the record and make the adjustments to the permit.
You will receive your notice of the extension via email, and it will be posted in the portal.

 

If your permit does not expire between September 23rd, 2022 and July 29th, 2024 use this process:

Complete an Extension/Reissuance form, which is available on our forms page. (Link to Form)
Email the completed form in PDF format to: permitdesk@cityofmarcoisland.com
A permit technician will attach your request to the record and depending on the scope of the permit send an inspector to the site to check for safety issues.
If it is determined that the permit can be reissued you will be notified by email and receive an invoice for the re-issuance fees.
If it is determined that the permit cannot be reissued you will be notified by email and provided with information.
You will receive your extension via email, and it will be posted in the portal.
