The Marco Island City Council has officially adopted Ordinance 25-06, which establishes new regulations for the operation of bicycles, electric bicycles (e-bikes), motorized scooters, and micromobility devices within the city’s municipal boundaries. The ordinance went into effect immediately following its adoption on second reading during the July 21st City Council meeting.

This ordinance was developed in response to growing safety concerns surrounding the increasing use of e-bikes on sidewalks and shared-use paths. It is intended to reduce the risk of crashes involving pedestrians, bicyclists, and vehicles by setting clear expectations for responsible operation. The City used its authority under Florida Statutes (§316.008 and §316.2068) to craft local rules that address these unique safety challenges.

Key Provisions of Ordinance 25-06:

  • 12 MPH speed limit for all bicycles, e-bikes, motorized scooters, and micromobility devices when operated on sidewalks and shared-use paths.

  • Devices must comply with all applicable Florida traffic laws, including traffic signals, yielding, signaling, and maintaining a safe speed.

  • Lane-splitting and leaving the roadway to bypass traffic signals are prohibited.

  • E-bike motors may not be modified to exceed manufacturer speed limits.

  • E-bikes are allowed in City parks only when operated manually (without motor assist).

  • Riders may only carry passengers according to the bike’s design capacity.

  • Operators must not enter roadways from sidewalks or curbs in a way that is so close that it is impossible for the driver to yield right-of-way.

  • On shared paths, sidewalks, and in parks and recreational areas:

    • Operators must yield to pedestrians

    • Must give an audible signal when passing pedestrians

The ordinance also includes expanded definitions and clarifications to Chapter 50 ("Traffic and Vehicles") and Chapter 34 ("Parks, Recreation and Public Facilities") of the City Code to ensure consistent enforcement and public understanding.
